From Lowering the Bar: Reasonable Consumer Would Know “Crunchberries” Are Not Real, Judge Rules.
Hooray for reason and logic, which have somehow triumphed in the face of frivolous lawsuits this time. Anybody that is halfway paying attention will be very much aware that the crunchberries cannot in any way be either construed or imagined to be real berries, and Cap’n Crunch is not committing fraud against consumers in naming the things. The judge’s ruling more or less amounts to “Ma’am, I refuse to believe that you are stupid enough to have expected these to be real berries after you have been regularly buying the product for two years, and neither would I expect anybody else to be similarly stupid. Now get out of my courtroom and stop wasting my time.”
